COGS (Community One Garden Services) TERMS AND CONDITIONS
These Terms and Conditions govern your use of COGS services and outline the rights and obligations of both parties. By engaging our services, you agree to comply with and be bound by the following terms and conditions.
Services offered
• Grass cutting, lawn edging for small to medium sized lawns. Usually regular fortnightly visits.
• Garden borders maintenance Deadheading flowers, Pruning of shrubs, tubs and climbers to shape (Called Border patrol on the invoice). Trimming small hedges/shrubs to shape.
• Garden Tidy, Rejuvenation & Restoration projects considered & undertaken.
• Horticultural and environmentally friendly approach to gardening.
• Planning for Garden maintenance & safe operating to support the ongoing evolution and maintenance of your garden.
• Hedge work (dependent on type & size).
Customer obligations
· Provide Accurate Information: Supply all necessary information regarding the requirements, site conditions, and desired outcomes.
· Access - The customer will provide suitable external access at the time of visiting to allow for equipment to go in and out along with any waste.
· Timely Payments: See payments section.
· Permits and Approvals: The client will obtain any necessary permits or approvals required for any project work.
· Waste - For minor works the clients green waste bin is usually sufficient.
· Pets: Owners are requested to ensure any areas due work are free of pet excretions, (I reserve the right of refusal if not removed). Pets should be kept securely away from the area whilst work is being undertaken.
· Utilities and energy - Where work requires water or mains electricity for power, Unless otherwise agreed in writing, the client agrees to their power, water & drainage to be used, at their own cost. If this is independently required, this will incur additional hire running costs.
· Toilet facilities - The company is working remotely and so access to the client’s toilet and hand washing facilities are essential and assumed unless specifically agreed. Travel to and from public facilities will be charged as time on the job.
Payments
· Fees and Charges: The Client agrees to pay the fees as specified in the Agreement. Fees may vary based on the scope of work, materials used, and any project complexity.
· Method & Frequency: On the day, by bank transfer preferred, I do not have facility accept credit cards, Cash acceptable for small jobs.
Larger projects will be subject to an agreed timing schedule, but payments as follows:
Late Payments: Late payments may be subject to interest charges and could result in project delays.
Cancellation and Termination - The Client may terminate the Agreement under the
following conditions:
In the event of termination, the Client is responsible for paying for all services rendered up to the termination date.
Liability - I strive to ensure the highest standards of work, however; COGS are not liable for:
Our liability is limited to the total fees paid for the specific project or work undertaken.
Privacy (GDPR) – My Client base is built on trust, and I take security of your data seriously. Payment is by secure Bank transfer, so account details remain totally private. Personal details are treated as confidential and are not willingly shared with any other companies (unless contracted in for project work). I take every reasonable step to protect us both but cannot accept liability for acts by third parties or negligence. I reserve the right to take photography or film for the purposes of providing quotes and to use before & after Shots on my website to promote my business. No confidential information is published without prior consent.
Materials: All project or specific work materials will be purchased by COGS before starting and this portion will be payable in advance (see payments). Once materials are purchased this is not refundable. A handling charge will be applied to allow for travel to source, load and unload goods & materials at client site.
Where a schedule of works is agreed, payment remains on the due day by bank transfer.
Warranties - I provide warranties on my workmanship and materials I purchase and use. If defects arise within the warranty period, I commit to repairing or replacing the affected parts without additional cost, provided the Client notifies me within 14 days of discovery (the agreed timeframe).
Planting materials – Whilst every effort is made to source great quality planting material there may be unforeseen issues that only become evident as the plant grows. My Liability is limited only to replacing the plants/materials I source from my preferred suppliers for up to a maximum of 3 months.
Dispute Resolution
In the event of a dispute, both parties agree to:
Legal actions should be a last resort after all other resolution methods have been exhausted.
Amendments - COGS reserves the right to amend these Terms and Conditions at any time. Clients will be notified of significant changes, and continued use of our services constitutes acceptance of the updated terms.
Acceptance - By engaging the services of COGS Community One Garden Services, the Client acknowledges that they have read, understood, and agreed to these Terms and Conditions.
